TERMS AND CONDITIONS FOR YOUR RESERVATION
1. The Reservation Fee will be processed via Stripe and will be credited towards your purchase price.
2. Payment of the Reservation Fee removes the Plot from the market for 10 days.
3. When the copy of the Purchase Agreement, signed by the Purchaser is received by the Vendor in the Cayman Islands, it will be countersigned there by an authorised signatory of the the Vendor. After signing by the Vendor’s signatory the Vendor will send a fully signed copy of the Purchase Agreement to the Purchaser at which time the Purchase Agreement will be binding on both parties.
4. On or before the Completion Date, the Purchaser must have made payment of the entire Completion Balance in cleared funds to the Vendor in the Cayman Islands.
5. The Payment Plan represents an option available to the Purchaser to pay the Completion Balance to the Vendor by equal monthly/quarterly payments over the agreed interest free period on the dates shown upon the schedule attached to the Purchase Agreement.
6. Individual Plot sizes are approximate and are offered by the Vendor in good faith but total accuracy is not guaranteed.
7. The Purchase Agreement shall be governed by and construed in accordance with the laws of the Cayman Islands and the parties here to submit to the exclusive jurisdiction of the Courts of the Cayman Islands and the English language of the Reservation shall prevail. Where there is a term in this Reservation that conflicts with a term in the Purchase Agreement then the term in the Purchase Agreement shall apply. The Vendor may require that the Reservation, or any such other document as the Vendor may nominate, at its absolute discretion, be signed electronically and which shall have the full validity and enforceability as a manually executed signature, in accordance with the Electronic Transactions Act.
8. The Purchaser covenants and warrants to the Vendor that all monies paid under this Agreement have been derived from lawful sources and expressly consents to any information relating to the Purchaser and to any funds paid by the Purchaser being released to any law enforcement authorities upon a lawful request being made to the Vendor for such information.
9. The value of land can fall as well as rise. The Vendor recommends each Purchaser to seek suitable advice from a qualified professional.
10. The Vendor offers plots of land for sale and is not an investment adviser or broker and does not provide financial advice. The Vendor offers no advice as to current or predicted land values and does not provide land management services.
11. The information contained throughout the promotional and marketing material of the Vendor is for illustration purposes only and is subject to change. Statements, figures, calculations, plans, images and representations are indicative only and do not constitute property particulars for contractual purposes.
12. When making payments overseas the Purchaser takes all risks for currency exchange, wire and any other fees.
13. The Purchaser understands that, by agreeing to these terms and conditions, they shall constitute a legally binding Agreement pursuant to and governed by the laws of the Cayman Islands. The Purchaser agrees that the Reservation, together with the Memorandum of Understanding and the Purchase Agreement shall constitute the entire agreement between the Vendor and the Purchaser. The Purchaser agrees that no terms whatsoever shall be implied to those specifically set out in the Memorandum of Understanding, the Reservation or the Purchase Agreement.
14. The Purchaser warrants that he, she or it (where the Purchaser is a corporate entity) has been advised by the Vendor that independent legal advice should be obtained from a Cayman Islands attorney prior to entering into this legally binding Agreement and that the Purchaser has had the opportunity to take independent legal advice before agreeing to these terms and conditions.
15. In the event the reservation fee is refunded Oasis is not responsible for any changes in the currency rate. If the reservation fee is paid in a different currency from USD the refund will be subject to any currency fluctuations on the date of refund. Refunds of the reservation fee may take up to 45 working days to be fully processed.
